The Customer must notify Strings Unlimited of all damages, shortages, or discrepancies at the time of delivery or in writing within 14 days of receipt of the goods. If the Customer fails to report to Strings Unlimited any damages, shortages, or discrepancies within 14 days from the delivery the Customer shall be deemed to have accepted the delivery as complying with the Customers order.

The title of the goods shall pass to the Customer upon payment of the full prices as stated on the invoice subject to paragraph 3.

The goods will be shipped out to the Customer only upon payment of full prices after Strings Unlimited submits all necessary certifications and documents as stated in the Proforma Invoice.

The risk of the goods shall pass from Strings Unlimited to the Customer on delivery of the goods to the premises or site specified by the Customer.

The Buyer shall examine the Goods, or cause them to be examined within as short period as is practicable in the circumstances. The Buyer shall notify the Seller of any lack of conformity of the Goods, specifying the nature of the lack of conformity, within 7 Business days (excluding Sundays) after the Buyer has discovered or ought to have discovered the lack of conformity. In any event, the Buyer loses the right to rely on a lack of conformity if he fails to notify the Seller thereof at the latest within 15 business days from the date of delivery of goods at the Buyer’s nominated Address. This does not affect the Buyer’s statutory rights.

Where the Buyer has given due notice of non-conformity to the Seller, the Buyer may at his/her option:

Require the Seller to deliver any missing quantity of the Goods, without any additional expense to the Buyer;
Require the Seller to replace the Goods with conforming goods, without any additional expense to the Buyer;
Require the Seller to repair the Goods, without any additional expense to the Buyer;
Reduce the price in the same proportion as the value that the Goods actually delivered had at the time of the delivery bears to the value that conforming goods would have had at that time. The Buyer may not reduce the price if the Seller replaces the Goods with conforming goods or repairs the Goods in accordance with paragraph 10.2.2 and 10.2.3 of this Article or if the Buyer refuses to accept such performance by the Seller;
Declare this contract avoided in accordance with Article 11 of this contract.

Strings Unlimited shall not be liable for any damages or claims arising out of the contract between Strings Unlimited and the Customer subject to these governed by law.

No variation of the Terms and Conditions will be binding on either Strings Unlimited or the Customer unless agreed by both parties in writing. No Director or employee has any authority to vary these Terms and Conditions otherwise than in writing.

Scottish law shall govern this contract.
